Terms of Service

1. Agreement to Terms

By accessing or using AUTOMIFYA services (the "Services") provided at automifya.es (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

2. Services

AUTOMIFYA provides professional website design and development services for small businesses. Services are described on our website and in your project proposal. All Services are subject to these Terms.

3. Account and Orders

When you place an order, you represent that (a) you are 18 years of age or older, (b) you have the right to provide the business information submitted, and (c) all information you provide is accurate and complete. You are responsible for maintaining the security of any account credentials.

4. Payment Terms

All prices are in USD unless otherwise specified. Payment is due at the time of order. We accept major credit cards processed by PCI-DSS-compliant payment processors. We never store your payment card details.

5. Delivery and Timelines

Estimated delivery timelines begin upon receipt of your completed onboarding form and any required content or materials. While we target 7-day delivery on Starter plans, timelines may extend if client revisions or content submissions are delayed. AUTOMIFYA is not liable for delays caused by client non-responsiveness.

6. Revisions

We provide unlimited revisions during the active revision period (from first preview to final approval). Revisions after final approval or more than 30 days post-delivery may be subject to additional fees.

7. 14-Day Money-Back Guarantee

If you are not satisfied with your delivered website within 14 calendar days of final delivery, we will refund 100% of the project cost. To request a refund, contact us at hello@automifya.es within the 14-day window. Refunds are not available after 14 days or after the client has approved the final design.

8. Intellectual Property

Upon final payment, you receive full ownership of all custom design work, code, and content created for your project. AUTOMIFYA retains the right to display completed work in our portfolio (unless you request otherwise in writing). You warrant that any content you provide (text, images, logos) does not infringe third-party rights.

9. Client Responsibilities

You are responsible for providing accurate business information, timely feedback, and any required content. You must ensure all provided content is legally owned by you or properly licensed. AUTOMIFYA is not liable for inaccuracies in client-provided content.

10. Limitation of Liability

To the maximum extent permitted by law, AUTOMIFYA's total liability for any claims arising from these Terms or our Services shall not exceed the amount paid by you for the specific project in question. We are not liable for indirect, incidental, or consequential damages.

11. Disclaimer of Warranties

Our Services are provided "as is." We do not warrant that our websites will achieve specific ranking positions, conversion rates, or business outcomes. SEO results vary based on many factors outside our control.

12. Governing Law

These Terms are governed by the laws of the United States. Disputes shall be resolved through binding arbitration, except where prohibited by law.

13. Changes to Terms

We may update these Terms at any time. Continued use of our Services after changes constitutes acceptance of the updated Terms.
