1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website at automifya.es ("Site") and any services provided by Automifya ("we," "us," "our"). By accessing the Site or entering into a service agreement with us, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.

2. Services

Automifya provides web design, development, and digital consulting services for small businesses, primarily in the US market. Specific services, deliverables, timelines, and pricing for each project are agreed in a separate project proposal or Statement of Work (SOW), which forms part of the contract between you and Automifya.

Our free tools (Website Speed Checker, SEO Meta Generator, Robots.txt Generator) are provided "as is" for informational purposes. Results are provided as guidance only and do not constitute professional advice.

3. Pricing and Payment

Service pricing

Our standard website packages are priced at $79.90, $99.90, and $134.90 USD respectively, as published on our pricing page. Prices are subject to change. The price agreed at the time of your project proposal is binding for that project.

Payment terms

• A deposit (typically 50%) is required before work begins
• The remaining balance is due upon project completion and before final file delivery
• Monthly retainer services are billed in advance on the first of each month
• All prices are in USD unless otherwise specified
• Late payments (beyond 14 days) may incur a 1.5% monthly interest charge

Refunds

Deposits are non-refundable once work has commenced. If you cancel a project after work has begun, you will be invoiced for all work completed to that point at our standard hourly rate. Completed projects are non-refundable. If we fail to deliver the agreed services, we will offer a redo or partial refund at our discretion.

4. Intellectual Property

Your content

You retain all intellectual property rights to content, logos, brand assets, and materials you provide to us. You grant us a limited licence to use them solely for the purpose of delivering your project.

Our work

Upon receipt of full payment, you receive full ownership of the custom code, designs, and content created specifically for your project. We retain the right to display the work in our portfolio and marketing materials unless you request otherwise in writing.

Third-party assets

Any third-party assets used (fonts, icons, stock images, plugins) remain subject to their respective licences. We will clearly identify any licenced third-party assets in the project handover documentation.

Site content

All content on automifya.es — including blog articles, tool descriptions, and marketing copy — is © Automifya 2026. You may not reproduce or redistribute our content without written permission.

5. Client Responsibilities

To enable us to deliver your project effectively, you agree to:

• Provide all required content, assets, and feedback within agreed timelines
• Ensure you have the rights to all materials you provide to us
• Designate a single point of contact for the project
• Respond to requests for approval or information within 5 business days (delays may extend the project timeline)

6. Acceptable Use

You may not use our Site or services to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Transmit harmful, offensive, defamatory, or fraudulent content
• Attempt to interfere with, hack, or damage our website or servers
• Scrape or copy our content or free tool outputs for commercial redistribution
• Build a competing product using our tools or methodologies

7. Disclaimer of Warranties

Our Site and free tools are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. Tool results (speed scores, meta tag suggestions, robots.txt output) are provided for informational purposes only and do not constitute a guarantee of search engine performance or ranking.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Automifya shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising out of or in connection with your use of the Site or our services.

Our total liability to you for any direct damages shall not exceed the total fees paid by you to Automifya in the three months preceding the claim.

9. Amazon Associates Disclosure

Automifya participates in the Amazon Services LLC Associates Program, an affiliate advertising program. Some blog posts may contain links to Amazon products with our affiliate tag (tag: salabertsauto-21). We earn a small commission on qualifying purchases at no additional cost to you. We only recommend products we genuinely believe are useful.

10. Third-Party Links

Our Site and blog may contain links to third-party websites. These links are provided for convenience only. We have no control over and are not responsible for the content, privacy practices, or accuracy of any third-party site. Inclusion of a link does not imply endorsement.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Spain (where Automifya is operated from), without regard to conflict of law principles. For US clients, disputes shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration under the rules of the International Chamber of Commerce.

12. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by updating the date at the top of this page. Continued use of our Site after changes constitutes acceptance of the updated Terms. If you do not accept the new Terms, you must stop using the Site.
